My intuitive morality tells me that it's a mild case, since although FDR could have chosen to defend against it, he did not himself order the attack. <br /><br />Our minds are genetically programmed to pay special attention to intentions. Intentional harm provokes the revenge drive much more than accidental harm or harm as a by-product. Even the Catholic Church endorses this distinction, although they believe it was handed down by God.<br /><br />Still, you could argue that FDR, since he knew about the imminent attack and did nothing, fully intended for Pearl Harbor to happen the way it did. First, I wanted to demonstrate how polarization of an issue causes us to think inside the box. Second, I wanted to make the point that neither side is convincing each other in the U.S., and so we need to make difficult compromises in order to progress. Third, I offered some potential compromises. They're good ones, really, yeah, in fact, Congress will be convening a special session to consider the One Free (Small) War of Adventure Per President proposal next Tuesday. One Free War, Get the Second One at Half-Price! What a savings!!! Yeah, so there's that.<br /><br />With reference to retributive torture, I see the temporary passage of a revenge torture law as a step in the direction of revealing to people that it is the primate revenge drive and not any rational or moral argument that underlies capital punishment, and retributive justice in general. Also, if such a law is combined with pro-rehabilitation laws, then would this be such a bad thing?
